Privacy

Acahua respects your privacy and is committed to handling personal information responsibly and transparently.

This Privacy Policy explains how LOPEZ & BONILLA PTY LTD., trading as Acahua (ABN 92 649 460 631), collects, uses, stores and shares personal information when you visit [www.acahua.com.au](https://www.acahua.com.au), place an order, contact us, subscribe to marketing or otherwise interact with Acahua.

1. Personal information we collect

Depending on how you interact with us, we may collect:

- your name, email address, telephone number, billing address and delivery address;
- order information, including products purchased, personalisation instructions, gift messages, discounts, returns and customer-service history;
- account information, if you create a customer account;
- payment and transaction information processed through Shopify and the payment method you select;
- marketing preferences and information about how you respond to our emails or promotions;
- reviews, photographs, messages or other content you choose to submit;
- device and website-use information, such as your IP address, browser, device type, pages viewed, referring website and approximate location; and
- any other information you voluntarily provide to us.

We do not ordinarily receive or store your complete payment-card number. Payments are processed by Shopify and the payment provider selected at checkout under their own privacy and security practices.

Please do not send us sensitive personal information unless it is genuinely necessary and we have requested it.

2. How we collect information

We collect personal information:

- directly from you when you place an order, create an account, join our mailing list, submit a review, contact us or make a return or warranty claim;
- automatically through Shopify, cookies and similar technologies when you use our website;
- through analytics and marketing services, including Google Analytics, where enabled;
- from payment, delivery and fraud-prevention providers involved in your transaction; and
- from social-media platforms when you interact with Acahua or use a social shopping feature, subject to your settings on that platform.

You may browse much of our website without identifying yourself. However, we need certain information to process an order, deliver products or respond to a request.

3. Why we use personal information

We may use personal information to:

- process payments, orders, personalisation, delivery, returns and warranty claims;
- communicate with you about an order or enquiry;
- provide customer service and maintain purchase records;
- prevent fraud, misuse and security incidents;
- operate, troubleshoot and improve our website, products and customer experience;
- understand website traffic and how customers use the store;
- request and display genuine customer reviews;
- send marketing communications where you have consented or where otherwise permitted by law;
- manage promotions, market events and customer relationships;
- meet accounting, tax, legal and regulatory obligations; and
- establish, exercise or defend legal claims.

We may combine information from different interactions where reasonably necessary for these purposes.

4. Marketing communications

We may send you email or other marketing communications when you have consented or where permitted by law.

You can unsubscribe from marketing emails at any time using the unsubscribe link in the message or by contacting sales@acahua.com.au. Unsubscribing from marketing will not stop essential communications about an existing order, return, warranty claim or account.

We do not sell mailing lists or personal information for money.

5. Cookies and analytics

Our website uses cookies and similar technologies to:

- keep the website and checkout functioning;
- remember preferences and cart contents;
- maintain security and prevent fraud;
- measure website traffic and performance; and
- support advertising or measure campaigns where those features are enabled.

We use Shopify’s ecommerce technology and may use Google Analytics to understand how visitors use the website. These services may collect information such as device details, browsing activity, IP address and approximate location.

Where available, you can manage non-essential cookies through the cookie or privacy controls displayed on our website. You can also adjust your browser settings to block or delete cookies, although some website and checkout functions may not work correctly as a result.

Some privacy laws describe certain advertising-cookie activities as “sharing” personal information. Where applicable, we provide the privacy choices required for the regions in which we operate.

6. When we share personal information

We may disclose personal information only where reasonably necessary to operate Acahua, fulfil an order or comply with the law. Recipients may include:

- Shopify, which hosts and operates our online store;
- payment providers and financial institutions;
- Australia Post and other delivery or fulfilment providers;
- email, customer-service, review, analytics, fraud-prevention and marketing providers;
- information-technology, hosting and security providers;
- accountants, insurers, lawyers and other professional advisers;
- government, regulatory, law-enforcement or dispute-resolution bodies where required or authorised by law; and
- a purchaser, adviser or successor if Acahua undergoes a genuine sale, restructure or transfer, subject to appropriate confidentiality and legal requirements.

Service providers are permitted to handle information only for the relevant service or as otherwise allowed by applicable law and their agreements with us.

7. Overseas processing

Some service providers process or store personal information outside Australia. In particular, Shopify and its providers may process information in countries including Canada and the United States. Google and other technology providers may also process information through international infrastructure.

Privacy and data-protection laws in those countries may differ from Australian law. Where required, we take reasonable steps to use providers and arrangements designed to protect personal information appropriately.

You can read more about Shopify’s handling of customer information in the Shopify Consumer Privacy Policy at https://www.shopify.com/legal/privacy/customers.

8. How we protect and retain information

We use reasonable administrative, technical and organisational measures to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

No internet transmission or storage system is completely secure. If you believe your interaction with us is no longer secure, contact us promptly.

We retain personal information only for as long as reasonably needed for the purposes described in this policy, including fulfilling orders, providing support, keeping business and tax records, resolving disputes and meeting legal obligations. When information is no longer required, we take reasonable steps to delete it or de-identify it, subject to technical and legal limitations.

9. Accessing or correcting your information

You may ask us to:

- confirm whether we hold personal information about you;
- provide access to personal information we hold about you; or
- correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.

Send your request to sales@acahua.com.au. To protect your privacy, we may need to verify your identity before completing the request.

We will respond within a reasonable time. In some circumstances, the law may permit or require us to refuse access or correction. If that happens, we will explain the reason where legally permitted and tell you about available complaint options.

10. Deletion requests

You may ask us to delete personal information by contacting sales@acahua.com.au. We will assess the request and delete or de-identify information where required or reasonably possible.

We may need to retain some information for legal, tax, accounting, fraud-prevention, dispute-resolution or order-record purposes. Deleting information may also affect our ability to provide an account, service or order history.

11. Privacy complaints

If you have a privacy concern or believe we have mishandled your personal information, contact us using the details below and explain the issue.

We will acknowledge and investigate the complaint and aim to respond within a reasonable time. We may ask for additional information to understand and resolve the concern.

If you are not satisfied with our response and the Privacy Act 1988 applies to the matter, you may contact the Office of the Australian Information Commissioner through www.oaic.gov.au.

12. Children’s privacy

Our website is intended for a general audience and is not directed at children under 16. We do not knowingly seek to collect personal information directly from children under 16 without appropriate consent.

If you believe a child has provided personal information without appropriate consent, contact us so we can assess and address the situation.

13. Third-party websites and social platforms

Our website may link to third-party websites, apps, payment services and social-media platforms. Their handling of personal information is governed by their own privacy policies. We encourage you to review those policies before providing information directly to them.

14. Changes to this policy

We may update this policy when our practices, technology or legal obligations change. The current version will be published on our website with the date of the latest update.

Material changes will apply from the date stated in the updated policy and will not retrospectively authorise a materially different use of personal information where consent or further notice is required.
